Biden is doing the right thing. IF he gets elected he will form a bi-partisan study commission to see how to make the courts appear less partisan. He also has to bring the court into the 21st Century. Those Federalist justices represent the status quo from 1910 or earlier.

If Amy, Brett and Neil prove to be as reactionary as Clarence and Sam, then the country will get angry. They may rule to close down the ACA, put major limits on abortion, allow voter suppression, deny civil rights and stuff like that. If they do they will be met with scorn and an increasingly strong call for change. The country will continue to lose respect for the court.

Meanwhile, if the Dems really control the WH and both houses of Congress, they can pass legislation that puts more light on the court — who they take big sums of money from for speaking? Who do they hang around with? There needs to be a stricter code of ethics.

Also the Legislative branch can pass laws that protect civil rights, workers, women, and voting. Then the court will be faced with striking down the will of the people.

Then there will probably be negotiations. Who might resign? Who can be pressured to defend their history of lying? Who has taken more money than is ethical? If the Justices get upset, then the Dems can show that they need to balance the court, and the country will be behind them. The Republicans will look as if they are defending corruption — which will be true.

But it’s too soon now. Maybe Amy will respond to the angels of her better nature. Maybe she will see the need to protect children who are already born more than a few cells in a petri dish. Maybe she will see that money is not the answer, but the root of all evil. Earl Warren was a Republican, so was Warren Burger.

I wouldn’t bet on that, but we have to see the evidence.
